The European Parliament has taken a decisive stand against indiscriminate surveillance of private communications, voting overwhelmingly to restrict how tech companies can scan user messages for illegal content.

The March 11 vote saw 458 members in favor, 103 opposed, and 63 abstentions, reflecting strong parliamentary support for tighter restrictions.

Under the revised framework, surveillance must be "proportional and targeted" rather than blanket monitoring of all users. Crucially, end-to-end encrypted platforms — including WhatsApp, Signal, and Telegram — are now explicitly excluded from scanning requirements.

Patrick Breyer, a digital rights advocate and former Member of European Parliament, characterized the decision as "a sensational victory," emphasizing that warrantless examination of digital correspondence should remain prohibited, just as physical mail enjoys protection.

The updated regulations introduce specific limitations: scanning can only target individual users or defined groups when judicial authorities have identified reasonable suspicion of CSAM-related activity. Audio messages are also exempt from monitoring.

Privacy advocates have consistently criticized mass scanning as both legally questionable and technically flawed. The practice conflicts with fundamental principles established in the ePrivacy Directive, which protects the confidentiality of electronic communications.

Despite being voluntary, widespread scanning has raised significant concerns. Recent evaluations, including one published by the EU Commission in November, have failed to demonstrate that the monitoring is proportionate to its stated goals, frequently producing false positives while yielding limited actual prevention results.

In February, the European Data Protection Supervisor issued an opinion stating that any extension must "address shortcomings and prevent indiscriminate scanning." More than 50 civil society organizations, cryptographers, and computer scientists signed an open letter opposing unrestricted continuation of the interim law.

Nevertheless, this represents only a temporary resolution. The permanent Child Sexual Abuse Regulation (CSAR) — dubbed "Chat Control 2.0" by opponents — remains under negotiation among EU institutions. Whether policymakers will maintain their rejection of mass surveillance in the final legislation remains uncertain.

Update: On March 16, negotiations between the EU Parliament and Council failed to reach agreement on the interim extension for voluntary CSAM detection, potentially creating a legal gap from April 4 if consensus isn't achieved during the next plenary vote scheduled for March 26.
